Welcome to Builds, a digital platform created by Cone Crows LLC ("we", "us", or "our") for car enthusiasts to track, showcase, and discuss their vehicles and modifications. By accessing or using the Builds mobile app or website, you agree to the following Terms of Use.

Please read them carefully.

1. Eligibility

You must be 18 years or older to use Builds.

By accessing or using Builds, you represent and warrant that:

You are at least 18 years old.
You reside in the United States.
You have the legal right and capacity to enter into this agreement.

2. Your Account

You may access Builds by registering via supported social sign-in methods (e.g., Google, Apple, Facebook). Your account is linked to your chosen social identity provider, and you are solely responsible for maintaining the security of that associated social media account.

We reserve the right to suspend or terminate your account at our sole discretion, including, but not limited to, if you:

Violate these Terms of Use or any other policies we may establish.
Upload, post, or share inappropriate, illegal, or infringing content.
Harass, abuse, stalk, or threaten other users.
Engage in any activity that disrupts or interferes with the operation of Builds or its users' experience.

3. User Content

You retain all ownership rights to the content you create and upload to Builds ("User Content"), including photos, videos, build logs, comments, and check-ins.

Please note that most User Content is intended for public display and interaction within the app.

However, by uploading User Content, you grant us (Cone Crows LLC) a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to:

Display, perform, and reproduce your User Content within the app and on our associated websites.
Store, transmit, distribute, and make your User Content available as part of the Builds platform.
Modify, reformat, or adapt your User Content solely for technical purposes to ensure proper display across different devices and formats.
Use your User Content (or portions thereof) for promotional purposes related to Builds (e.g., app store screenshots, marketing materials).
Monetize your User Content, including by displaying advertisements (which may be injected directly into videos or other media), or by otherwise generating revenue from its display and distribution.

You are solely responsible for your User Content, and you represent and warrant that:

You own or have the necessary rights and permissions to use and authorize us to use all intellectual property rights in and to your User Content.
Your User Content is legal, appropriate, and does not violate these Terms of Use or any applicable law or regulation.
Your User Content does not infringe upon the intellectual property, privacy, publicity, or other personal or proprietary rights of any third party (e.g., copyrighted media, trademarks).

4. Acceptable Use

Builds is a curated platform for car enthusiasts to share their vehicles, modifications, and experiences. It is not a public forum for unrestricted expression.

By using Builds, you agree not to:

Post content that is illegal, offensive, or discriminatory
Promote political, religious, or ideologically divisive content
Harass, impersonate, or threaten other users
Upload spam, advertisements, or misleading material

We reserve the right to moderate, remove, restrict, or alter any content at any time, regardless of whether a specific rule has been violated.

We do not guarantee unmoderated or "free speech" zones on Builds. Moderation decisions are editorial in nature and are made in service of creating a respectful, focused community.

Repeated or severe violations may result in account suspension or termination.

5. App Usage and Licensing

Builds is licensed, not sold. We grant you a limited, non-exclusive, revocable license to use the app for personal, non-commercial purposes.

You may not:

Modify, copy, or redistribute the app
Use automated tools to scrape or abuse the platform
Violate any applicable laws while using Builds

6. Location and Check-Ins

Some features allow you to share your location or check in to events. These are optional and only collected with your permission.

You understand that:

Location data may be shared with other users (e.g., in event feeds)
You are responsible for what you share and when

7. Ads and Sponsorship

We may include ads or sponsored content in the app in the future. By using Builds, you agree that:

Ad content may be shown based on your activity or preferences
We do not endorse third-party ads, and your interactions with them are your responsibility

8. Termination

Termination by Us:
We reserve the right to suspend or terminate your account and your access to Builds at our sole discretion, without prior notice, if you violate these Terms of Use, abuse the service, or engage in any conduct we deem harmful to the platform or its users. The specific reasons for termination are further outlined in Section 2 (Your Account).

Account Deletion by You:
You may delete your account at any time through the app's settings.

Effect of Account Termination or Deletion:
Upon the termination of your account by us, or the deletion of your account by you:

Your profile and direct access to your account will be deactivated.
Most content directly associated with your main profile (such as your personal Builds, Rides, and check-ins) will be removed from public view or de-associated from your profile.
However, to maintain the continuity of discussions and the integrity of the platform, certain User Content you have posted, such as comments or discussion posts, and associated information (like your name and profile picture at the time of posting), are designed to remain visible on the platform. This is consistent with Section 3 (User Content).
We may retain minimal system logs and other necessary data for security, audit, and legal compliance purposes for a limited period, as further detailed in our Privacy Policy.

9. Disclaimers

Builds is provided to you "as is" and "as available," without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, and NON-INFRINGEMENT. We do not warrant that the functions contained in Builds will be uninterrupted or error-free, that defects will be corrected, or that Builds or the servers that make it available are free of viruses or other harmful components.

Limitation of Liability:
To the fullest extent permitted by applicable law, Cone Crows LLC, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use Builds; (ii) any conduct or content of any third party on Builds; (iii) any content obtained from Builds; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Specifically, and without limiting the generality of the foregoing, we are not responsible for:

User-generated content, including its legality, accuracy, or appropriateness.
Data loss, service interruptions, delays, errors, or security breaches.
The content, practices, or availability of third-party links, apps, or services integrated with or linked from Builds.
Any actions or inactions of other users on the platform.

10. Changes to These Terms

We may update or modify these Terms of Use from time to time. If a change is material, we will notify you through the app, on our website, or via email (if you have provided us with one).

By continuing to access or use Builds after such updates become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using Builds and delete your account.
